Sales, subscription and payment terms
Version 2026.11.05.1 · Approved by SMARTEDTECH SL (owner) · Effective 1 November 2026
1. Supplier and offer
For direct purchases, the supplier is SMARTEDTECH SL, tax ID B66970831, Carrer Agricultura, 16, 1º, 9ª, 08320 El Masnou, Barcelona, Spain. These terms apply to personalised digital artwork from authorised iris images, photographs or voice and separately ordered physical prints. Prices are shown on the pricing page and again before payment, and the contract is formed when you complete payment for an order. Payment is requested only after you approve the preview, and no final artwork is produced before payment. An individual may be a consumer, sole trader or representative; choosing a business-looking account does not remove statutory consumer status. Digital finals and personalised physical goods have different withdrawal rules. Approval of a preview is not by itself consent to lose digital-content withdrawal rights. Iris or voice art is not biometric identification; no identity template, medical inference or biometric reuse is authorised.
2. Before you commit
The final review identifies supplier and any separate provider, service/content, quantity, user/seat or licence limits, delivery/access term, technical compatibility, total price and currency, taxes and all unavoidable charges. Recurring offers state billing interval, minimum commitment, renewal, cancellation and the total for the commitment. Usage-based products state included allowance, unit price, cap and human approval for extras. An enterprise calculator is an estimate until an authorised quote is accepted. A payment return page does not itself confirm settlement. The order confirmation states whether the order has been accepted and when supply begins.
Country, customer tax status, supply type and seller establishment determine tax treatment. Consumer totals include applicable taxes; business quotes state their tax treatment. Validate any reverse-charge/exemption before applying it and explain location/identity evidence. Do not substitute a single global VAT rate or infer exemption from a nonprofit/public-body label. The same currency and amount shown in the accepted order apply to the charge. Any currency conversion and its cost are disclosed before agreement.
3. Contract formation and payment
The customer can correct errors and read/save the exact version and order before acceptance. A required unchecked terms box is separate from optional choices. Where an order is placed online, the final step is a clearly labelled Order with obligation to pay action, or equally unambiguous local wording. The receipt names the parties, offer, price/tax snapshot, term, accepted documents and valid withdrawal choices and provides a durable copy. Payment is recorded through verified provider events or authorised reconciled bank receipt; a screenshot or browser redirect is insufficient. Duplicate charges are investigated and corrected.
4. Provision and conformity
We provide the agreed service with legally required care and conformity. Access starts on the stated date after the actual conditions are satisfied. Delays, defects and service changes are communicated with the available statutory and contractual remedies. AI error risk does not exclude our own obligations. We do not guarantee an uncontracted business, clinical, educational or financial outcome.
5. Renewal and cancellation
The accepted order fixes the interval and cancellation deadline. In the absence of a separately disclosed longer commitment, the recurring plan is monthly; cancellation received before renewal prevents the next period. Customers can cancel by writing to support@iuniq.art or to the postal address above, without a retention-only telephone obstacle. Cancellation confirmation states the last service day and final charge. Price changes apply prospectively with at least 30 days' notice for optional renewals; fixed commitments are not rewritten. Consumer statutory rules may require more. Cancellation of renewal is different from withdrawal, account closure and a provider booking cancellation.
6. Withdrawal and refunds
The separate Withdrawal and Refund Policy distinguishes services, digital content and sector exceptions. No general all payments non-refundable term applies. Refunds for defective/non-conforming supply, duplicate charges and mandatory rights are preserved even where a valid withdrawal exception applies. Refunds return through the original lawful payment method without an undisclosed deduction; the order identifies who processes a third-party refund.
7. Complaints, liability and law
Send the order reference and issue to support@iuniq.art; do not send full card details. A person reviews consequential disputes. No consumer indemnity or cap excludes mandatory liabilities, fraud, deliberate wrongdoing, injury or statutory data rights. Spanish law governs subject to mandatory law. Barcelona courts are chosen for a business dispute only where that choice is legally valid. Consumers keep mandatory protections and courts, including those of habitual residence where applicable. Public procurement, professional and statutory exclusive jurisdiction prevail. No mandatory remedy or access to a regulator is waived.
